Clarity Act Update: Trump Backs Ethics Terms as Senate Negotiations Advance

President Donald Trump has reportedly approved ethics terms for the Clarity Act after weeks of talks with Senate Republicans. The proposed package addresses rules for federal officials who hold or profit from digital assets while serving in office.

White House officials have circulated the language to selected Republican senators. However, Democrats have not reviewed the final text. Lawmakers now face a narrow schedule before the Senate leaves Washington for its August work period.

Clarity Act News: White House Clears Key Ethics Provision

The reported agreement followed discussions involving Trump, Senator Cynthia Lummis, Senator Bernie Moreno. It also included White House crypto adviser Patrick Witt. Trump met the senators on July 16 as negotiators worked to settle the most disputed part of the bill.

Reports said the meeting ended without a final decision, but the president later accepted an ethics package on July 20.

The exact language has not entered the public record. Reports indicate that the provision would limit presidents, vice presidents, and members of Congress from profiting from digital assets during public service.

Senate Democrats have pushed for broad restrictions that also cover financial interests connected to senior officials and their families.

Customer Protections Enter Revised Bill

Negotiators have also added stronger customer protection measures to the Senate version. Coinbase Vice Chair Ryan VanGrack said Democrats secured changes that place digital asset users at the center of the framework.

He did not release the revised language, and Senate committees have not published the latest full text.

Earlier Senate drafts include registration rules, disclosure duties, market conduct standards and protections against insider trading. Lawmakers have also discussed illicit finance controls and rules designed to address failures exposed by the collapse of FTX.

The final package may contain further changes once negotiators complete work across the Banking and Agriculture committees.

Senate Vote Still Requires Bipartisan Support

The ethics agreement removes one source of disagreement, but it does not guarantee a floor vote. Senate leaders must complete the text, distribute it to members, and secure enough support to advance the measure.

Most major bills need 60 votes to overcome procedural resistance in the chamber, requiring Republican leaders to attract Democratic votes.

Senate Banking Committee members advanced H.R. 3633 in a bipartisan vote on May 14. The House had approved the earlier version by a 294-134 vote in July 2025. Any Senate changes would require another House review before lawmakers could send the final legislation to Trump for signature.

The Senate calendar leaves lawmakers limited time to finish negotiations before the August work period. Supporters have discussed possible action during the final weeks of July or the first week of August.

Senate leaders have not announced a floor date, and negotiators have not publicly released the revised text. Republican and Democratic negotiators must still agree on the complete wording before Senate leaders can begin floor proceedings.

Clarity Act Defines Federal Crypto Oversight

The Clarity Act creates a federal structure for digital asset markets and divides oversight between the SEC and the CFTC.

The crypto bill also sets standards for exchanges, brokers, token issuers, and other market participants. The framework would replace many enforcement-led decisions with written rules approved by Congress and implemented by regulators.

Prediction markets responded to the reported White House agreement. Polymarket placed the chance of the Clarity Act becoming law in 2026 near 42% on July 21, after lower readings during the ethics dispute.

Senate negotiations cover several subjects beyond ethics and customer safeguards. Lawmakers continue discussing stablecoin rewards, decentralized software developers, and law enforcement powers.

The proposed Blockchain Regulatory Certainty Act would protect qualifying developers from money transmitter rules when they do not control customer funds or execute transactions.
