Meet The Top 10 US Regulator Settlements In The Crypto Industry
  • Crypto companies have settled with US regulators for billions of dollars.
  • At the top of the list are Celsius Network, FTX, and Terraform Labs.
  • Significantly, cryptocurrency companies such as Crypto.com have begun to retaliate.

Crypto projects and exchanges have had to reach large US regulator settlements during the past two years. The US Securities and Exchange Commission (SEC) is the organization that is spearheading most of these actions against cryptocurrency firms.

The Commodity Futures Trading Commission (CFTC) has also provided settlement information for a few digital asset trading companies. CoinGecko has compiled a list of the top ten crypto settlements that US regulators have approved in recent years.

Billions of dollars in settlement have been done by FTX, Celsius Network, and Terraform Labs

The Bahamian-based FTX Derivatives Exchange collapsed in 2022 due to poor cash management. Alameda Research, FTX’s sister trading company, was granted access to its user deposit under Sam Bankman-Fried’s direction.

Fraudulent investments caused its eventual collapse. This also caused many other cryptocurrency companies to fail.

The digital currency exchange has faced over two years of bankruptcy proceedings and multiple investigations. Recently, it reached a $12.7 Billion settlement with the CFTC. This included $8.7 Billion in restitution and a $4 Billion disgorgement fee.

The Federal Trade Commission (FTC) demanded $4.7 Billion from Celsius Network in July 2023. This amounted to one of the highest settlement amounts ever recorded by the regulatory body.

The crypto lender was also permanently barred from marketing, offering, or promoting any cryptocurrency assets, as were its affiliates. Celsius Network emerged from Chapter 11 bankruptcy in April, having been bankrupt for over a year.

The collapse of Terraform Labs was another of the biggest blows to the cryptocurrency industry in 2022. The collapse of the exchange had a huge impact on the market, wiping out over $1 Trillion from the total market capitalization.

Do Kwon, the exchange’s co-founder, and the company were ordered to pay $4.5 Billion in civil fines. Following this US regulated settlement, Terraform Labs was subject to a permanent ban. The firm faced a ban on trading in cryptocurrency-based securities, similar to Celsius Network.

Founders Wend Jail as Binance Paid $4.30 Billion in Settlement

Binance agreed to pay $4.3 Billion to settle charges brought against it almost a year ago. The resolution of the US Department of Justice’s (DOJ) investigation into a possible Bank Secrecy Act violation will determine how much is involved.

As part of the larger penalty, Changpeng Zhao, the founder of Binance, spent four months in prison. He just got out of jail after completing his term.

Social media networks Telegram ($1.24 Billion), Genesis ($2 Billion), and Voyager Digital ($1.65 Billion) were the subject of additional settlements. BitMex, Coinbase, and BlockFi each paid $100 Million to settle their respective cases.

In BitMex’s case, it consented to settle with US regulators by paying the fine. It was charged by the CFTC and the Financial Crimes Enforcement Network (FinCEN) with accepting customer funds for trading illegally. The derivatives trading firm accused it of acting as an unregistered broker.

Crypto.com sues SEC for Wells Notice

These cryptocurrency initiatives have begun to challenge US regulators in recent times. Crypto.com filed a lawsuit against the SEC earlier this week after receiving a Wells Notice from the commission.

The Wells Notice indicates a high probability of enforcement action, even though it is hardly one. By acting this way, the exchange takes the market regulator seriously.

With time, cryptocurrency exchanges may adopt a strategy of opposing the actions of the authority in the US regulated settlements.
