SEC Opposes Inclusion of Outside Evidence In Ripple vs. SEC Case

Key Insights:

  • The SEC opposed a third party’s emergency filing in the Ripple case, citing legal limits.
  • Ripple agreed to a partial settlement of $50M with the SEC, ending key parts of the lawsuit.
  • The court lacks the authority to act on Keener’s request because the case is under appeal.

The legal battle of Ripple vs. SEC continues to draw widespread attention. The SEC has formally objected to a filing from Justin W. Keener. This filing was unsolicited and has now added complexity to the case. The financial and cryptocurrency sectors are closely watching the developments.

Justin W. Keener, who is not directly involved in the case, filed an “Emergency Request to Present Decisive Evidence.” This filing was made in support of Ripple Labs on April 3, 2025.

According to Eleanor Terrett, the SEC responded days later, urging the court to reject the motion. Meanwhile, the Ripple vs. SEC case continues to evolve. Ripple recently reached a partial settlement involving a reduced financial penalty with the SEC.

SEC Challenges Justin Keener’s Filing in Ripple vs. SEC Case

The SEC’s latest filing argued that the court lacks jurisdiction to consider Keener’s request because the matter is under appeal. The Ripple vs. SEC case has already proceeded to a higher court. The Commission has emphasized that the lower court cannot act on such submissions.

In addition to jurisdictional issues, the agency noted that Keener has not sought to intervene in the case formally. Referring to earlier similar attempts by other individuals, the SEC highlighted that the court denied prior third-party filings.

Based on this precedent, the agency argued that Keener’s motion should be dismissed without further consideration. Moreover, the SEC stated that Ripple’s legal counsel remains fully capable of determining the usefulness of external materials.

The filing suggested that Keener contact Ripple’s legal team directly if he believed his evidence was relevant. This approach would avoid involving the court unnecessarily.

The Commission underlined that this alternative route remains available and appropriate, negating the need for a court-level review.

Background on Keener and the Filed Evidence

Recall the emergency motion submitted by Keener on April 3, which was unusual in both content and presentation. It referenced an intent to provide “decisive evidence in favor of the defendants and favor of liberty for the American people.”

However, the filing failed to specify the nature of the evidence or its connection to the case. Preliminary research into Keener revealed that the SEC previously sued him for operating as an unregistered dealer of penny stocks.

A court ordered him to pay penalties of more than $10 Million. This context has added further complexity to the recent filing. However, the SEC has not formally connected Keener’s history to its current opposition motion.

The reference in Keener’s letter to “physical investment contracts” raised questions about the material’s relevance. Firstly, it is noteworthy that Keener’s reference to “physical investment contracts” disturbed watchers.

The filing did not clarify the impact of these contracts on Ripple vs. SEC. It also lacked details on how XRP’s legal characterization would be affected.

Ripple Settlement Update and Appeal Withdrawal

While Keener’s filing unfolded, Ripple Labs demonstrated progress in the Ripple vs. SEC dispute. Signs of improvement have emerged in the long-standing legal battle.

On Tuesday, Ripple’s Chief Legal Officer Stuart Alderoty disclosed that the company had agreed to a partial settlement. The SEC would retain $50 million of a previously imposed $125 Million civil penalty.

This amount, currently held in escrow, continues to accrue interest pending judicial approval. Ripple also confirmed it will end its appeal of a decision by U.S. District Judge Analisa Torres.

In July 2023, the ruling declared that Ripple’s institutional XRP sales, amounting to $728 Million, were subject to securities laws. It highlighted that these sales should have adhered to regulatory compliance standards.

Although Ripple initially challenged this decision, Alderoty stated that the appeal would now be withdrawn. Meanwhile, the SEC had earlier concluded its appeal of the same ruling.

The appellate issue centered on the determination that XRP sales on public exchanges did not meet the legal criteria for securities. With both parties stepping back from further appeals, the case’s core appears nearing resolution.
